A man who was involved in a crash in Los Angeles that left a woman injured is speaking out, saying he was “burdened with regret” and “shaken up” when he drove off. “I felt like an animal, like I should be dead. I was in the middle of the street,” the driver, 24-year-old Joshua Smith, told ABC7, noting that he was driving a Mercedes Benz. Smith admits he hit 16-year-old Alysia Arana by mistake, and said he was shocked and hurt when a car struck his window. However, Smith has now filed suit alleging his “burden” was over, and he was not entitled to any compensation.
“The accident happened when I was just coming home from work,” he said. “I hit her and she was laying here. I was surprised there was nobody around but she wasn’t seriously injured. They took my car, my car for sure. I was just shocked it happened that fast.” He was the driver in connection with a crash on July 19th that caused the death of 26-year-old Brittany Smith, and her injuries.
The Daily Mail UK reports that the mother-of-two told officers that Smith and his friend, Joseph Bower, ran a red light on Spring St., before stopping on Elm St. and leaving the road. Their Mercedes was driven by Joshua “J-D” Brown. Smith told investigators that his blood alcohol was at the .08% levels he typically takes, but the legal limit for driving is .08%. The driver in the crash, Smith said, was “dumbfounded and surprised” and “shaken up” in the collision, and has refused to talk to police.
An initial charge of DUI, reckless driving, was dropped for reckless driving. Smith was granted a $2,000 in compensatory damages by a judge and an additional $1,000 in punitive damages following his deposition. While Smith was facing two counts of reckless driving, both charges have been dropped and instead a judge granted him a $5,000 punitive damages award
