The new federal guidelines define a mental health condition as any persistent or recurrent mental disorder with onset within 2 months of age that does not meet diagnostic criteria for one of the following: Major depression; bipolar disorder; schizophrenia; Tourette syndrome; substance abuse disorder; or psychotic disorders.
Do I have to get help for my mental health condition?
Yes, you must get treatment if necessary for mental health problems. But, getting help may not be an easy task. You may be asked to submit personal information, or face sanctions for not participating.
Who must be included in the pilot program?
The federal guidelines specify that eligible persons who have not had their health plans cancelled or reduced by the employer because of their mental health condition, have been discharged or are being discharged by a state or local government employee must be included.
The guidelines also require the following categories of qualified persons to participate:
A student or former student who is currently enrolled in any degree, diploma or certificate-granting college or university, or is enrolled full-time in a postsecondary institution to qualify for the program; A member of a family with a mental health condition (or other mental health condition that adversely affects living environment) who has not had his or her health plan cancelled or reduced by the employer due to his or her mental health disorder or whose mental health crisis has not been adequately treated through an institutional or private mental health facility; A veteran with a mental health condition that adversely affects living situation who has not been discharged from Active duty service or is being discharged from Active duty service.

Are employers eligible to join the pilot program?
An eligible employer can join the pilot program if a reasonable and appropriate plan has been presented and approved by the National Provider Identifier (NPI) system that identifies mental health and substance abuse services, as well as mental health and substance abuse treatment information and referral. These regulations require an employer with 50 or more employees to complete an online form to ensure compliance. Employers can also create and participate in an on-line form to ensure compliance.
Do individuals who are currently enrolled in any degree, diploma or certificate-granting college or university still have to be included in the pilot program?
